Washington, D.C. — The U.S. 5th Circuit Court of Appeals released a lengthy and mixed decision in the Texas v U.S. case concerning the future of the Deferred Action for Childhood Arrivals (DACA) program. In their decision, the 5th circuit shared that they believe the new DACA rule is unlawful, yet still chose to limit the effect of its ruling in several important ways, underscoring the ways DACA recipients have been critical to the stability and success of the country’s economy, communities, and more.
As of now, all current DACA recipients are still protected, authorized to work, and can renew their protections, regardless of what state they live in.
Representatives from the Home Is Here Coalition — encompassing over 100 organizations across the country — released the following statement:
“DACA is proof that a program that is right and has immense impact across the country doesn’t easily crumble. States and local communities and economies across the country – and the country at large– greatly benefit from DACA, and the 5th Circuit Court’s decision today to limit the effects of its own ruling shows that they know this.
As we speak, the incoming Trump Administration is prepared to unleash a slate of anti-immigrant attacks starting that will have catastrophic ripple effects on working families and communities across this country – including DACA recipients. No industry, no community, no city, will be immune to the devastating impacts of a detention and deportation agenda. Trump’s track record of going after DACA makes it all the more urgent for USCIS to continue processing renewals and for Congress to take immediate action to deliver permanent protections. We also urge elected officials at every level to leave no stone unturned in shoring up protections for immigrants across the country.”
