The Last Set of Briefs on the DACA Case in Judge Hanen’s Court were just filed! But the Texas DACA case is still ongoing. Here’s what you need to know. 

What’s happening with DACA:

On Monday, November 24, all parties in the current DACA case filed their last set of briefs with Judge Hanen’s court. Here are the main take aways:

  • All parties, except Texas, agreed that Judge Hanen’s future decision on the future of DACA should only apply to those living in Texas, and no one else.
  • There was no further information on how the separation of access to work permits from deportation protections for DACA recipients in Texas could be implemented.
  • There was no information in the future of initial DACA applications.

What does this mean for DACA recipients?

  • These briefs are not final decisions. They do not mean changes to the program right now. 
  • Renewals continue to be processed and adjudicated for the whole country with FULL DACA benefits, including access to work permits, for all DACA recipients, including those in Texas.
    • We encourage DACA recipients to continue renewing their protections. 
  • Initial applications for DACA eligible people are still paused with no estimate on when/if they could restart. Right now, there are no guarantees on how this will move.
    • We highly encourage initial applicants to consult with a legal service provider before applying given the financial commitment and other risks involved.

What happens next?

  • Judge Hanen will either announce a hearing schedule or make his final decision.
    • Timing on this is unclear as Judge Hanen does not have a deadline.
  • Meanwhile, this Administration has been clear in its actions. DACA recipients and immigrant youth are being targeted for enforcement, detained and deported.
    • Congress must act and pass permanent protections for all immigrant youth and their communities.
