DACA Update: Judge Hanen’s Response

Judge Hanen has stopped the new DACA rule from going into effect. Judge Hanen has prevented the new DACA rule, set to replace the 2012 DACA memo inside DHS, from going into effect on Oct. 31 while he waits to make a final decision. DHS will continue to accept DACA renewals and advance parole for current DACA recipients. 

What happens to DACA recipients and DACA eligible youth?

Nothing has changed as of now! 

  • If you have DACA right now: you are still protected and will be able to continue renewing for now. 
  • Advance Parole will remain open to DACA recipients for now. 
  • If your first-time DACA application has not been granted as of July 16, 2021. DHS will NOT grant your request. 

DACA is dying.

Judge Hanen’s order and remarks in court today makes it clear that no pro-immigrant decision will come out of his court. He’s tried to fully end DACA before, and has already shown opposition to the new DACA rule. We must be ready for the official end of DACA.
