U.S. District Court Judge Hanen has ruled against DACA again. Despite this, the DACA program continues open for renewals for now! Here’s what you need to know:

What does this ruling mean?

Despite Judge Hanen’s attempt to end DACA once again, right now DACA remains open for renewals and for advanced parole only. However, this new ruling continues to deny hundreds of thousands of DACA eligible youth the ability to access DACA for the first time.

What happens to DACA recipients and DACA eligible youth? Nothing has changed!

  • If you have DACA right now: you are still protected and will be able to continue renewing for now. 
  • If you are eligible for DACA but have never applied: DHS can still accept your application but will NOT be able to process it. 
  • Advance Parole will remain open to current DACA recipients. 

DACA is DYING and actively under attack from far right politicians.

The Fifth Circuit, who has ruled against DACA before, will now be next to decide the future of DACA and the case may eventually make its way to the Supreme Court again. But no matter what the court says, we know that DACA is right and legal.
